1. What Information Do We Collect?

Personal information you disclose to us

In Short: We collect personal information that you provide to us, primarily through our authentication provider.

We collect personal information that you voluntarily provide to us when you register for the Service through our third-party authentication provider, when you interact with us, or when you contact us. Authentication is handled by WorkOS AuthKit, which may in turn route you through an upstream identity provider such as Google or GitHub. As part of this flow, we receive:

  • your name (first and last, if provided)
  • your email address
  • a unique account identifier from the authentication provider
  • if applicable, basic profile information from the upstream identity provider (such as an avatar URL)

If you (or your organization) configure additional integrations through the Service — for example, connecting a Weights & Biases account, a Hugging Face account, an SSH key, or a code repository — we will also collect the credentials, tokens, or identifiers necessary to operate those integrations on your behalf.

Payment information. If you use paid features of the Service, our third-party payment processor (Polar) will collect payment information (such as card details or other billing identifiers) directly. OpenResearch may receive identifiers and metadata associated with charges to your account.

Sensitive Information. We do not request or process sensitive personal information (such as government identifiers, biometric data, or precise geolocation) as part of normal use of the Service.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address, device characteristics, and details of how you use the Service — is collected automatically when you use the Service.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not on its own reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, country, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, to authenticate you, to debug issues, and for our internal analytics and reporting purposes.

The information we collect includes:

  • Log and Usage Data. Diagnostic, usage, and performance information our servers automatically collect when you access or use the Services, including request timestamps, the API endpoints and pages you accessed, the actions you took, and error reports and stack traces.
  • Device Data. Information about the computer, phone, tablet, or other device you use to access the Services, including IP address (or proxy server), device and application identifiers, location inferred from IP, browser type, hardware model, Internet service provider, operating system, and system configuration information.
  • Compute and Resource Usage Data. When you provision and use compute resources through the Service, we record metadata about that usage (for example: which provider, instance type, GPU class, start and end times, duration, and aggregate resource consumption) so that we can operate, meter, and bill for the Service.
  • Website Product Analytics. We use PostHog to collect website product analytics events (such as which pages you viewed and which features you used) to understand how the Service is used and to improve it. These events are tied to your account identifier.
  • CLI Product Analytics. Official openresearch-cli builds send first-party, anonymous usage events to OpenResearch. These include a random installation identifier, command and coarse feature labels, CLI version, operating system and architecture, dashboard display language, CI status, install type, and—if submitted—research-area categories and linked-paper count. CLI analytics do not include account identifiers, IP addresses, user-agent strings, research-profile free text, paper identifiers or titles, source code, prompts, file paths, repository names, or tokens. You can disable them with orx telemetry off or --no-telemetry.

2. How Do We Process Your Information?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, prevent abuse and ensure security, meter and bill for paid usage, and comply with law.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication. We process your information so you can create and log in to your account, and to keep your account in working order. Authentication is delegated to WorkOS AuthKit, which may route through an upstream identity provider.
  • To deliver and operate the Service. We process your information to provision and operate the compute environments, storage, and other features you request through the Service.
  • To send administrative information to you. We may process your information to send you details about changes to our terms and policies, security notices, billing notifications, and other operationally important communications.
  • To meter and bill for paid usage. We use compute and resource usage data to calculate fees for paid resources and to invoice you (or your organization) for that usage through our payment processor.
  • To prevent abuse and ensure security. We use information about how the Service is being used to detect and prevent fraud, abuse, security incidents, and use of the Service in violation of our Terms of Service or applicable law.
  • To improve the Service. We use aggregated usage and analytics data to understand how the Service is being used and to improve it.
  • To respond to support requests. When you contact us for support, we may process your information (including, with your consent or at your direction, accessing your account or compute environments) to investigate and respond to your request.
  • To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual's vital interest, such as to prevent harm.

3. What Legal Bases Do We Rely On To Process Your Personal Information?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time.
  • Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.
  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to analyze how our Services are used so we can improve them, to detect and prevent abuse, and to operate billing.
  • Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.
  • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

If you are located in Canada, this section applies to you.

We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
  • For investigations and fraud detection and prevention
  • For business transactions provided certain conditions are met
  • If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
  • If the information is publicly available and is specified by the regulations

4. When And With Whom Do We Share Your Personal Information?

In Short: We share information with vendors and service providers that help us operate the Service, as needed for those providers to perform their function, as well as in the other situations described below.

We use the following categories of third-party service providers ("subprocessors") to operate the Service. Your personal information may be shared with these providers as necessary for them to provide their respective service:

  • Authentication. WorkOS provides our hosted authentication (AuthKit). WorkOS processes your name, email, and authentication metadata in order to authenticate you and manage your session.
  • Website product analytics. PostHog processes website product analytics events tied to your account identifier, IP address, and device metadata, to help us understand and improve how the Service is used. CLI analytics from current releases are sent directly to OpenResearch and stored in our Postgres database instead.
  • Compute providers. When you provision GPU or compute resources through the Service, the underlying compute is operated by third-party infrastructure providers, currently including RunPod and Vast.ai. The code, datasets, and other content you cause to be executed will be transmitted to and processed on these providers' infrastructure.
  • Email. Resend delivers transactional and operational emails (such as invitations, security notices, and billing-related messages) on our behalf.
  • Billing and payments. Polar processes payments and subscription management for the Service. Polar collects payment details directly; we receive identifiers and metadata associated with charges to your account.
  • Hosting and infrastructure. Our backend application is hosted on commercial cloud infrastructure (currently including Railway). Hosting providers may incidentally process information transiting our Service as a function of operating the underlying infrastructure.

We may also share your personal information in the following additional situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Legal obligations and rights. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, or where disclosure is necessary to protect our rights, your safety or the safety of others, or to investigate fraud or violations of our Terms of Service.
  • Within your organization. If you are a member of an organization on the Service, other members and administrators of that organization may be able to see your name, email, and activity within that organization.

This list of subprocessors may change over time as we adopt or change vendors.

5. How Long Do We Keep Your Information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, billing, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which you have an account with us, plus a reasonable period thereafter to satisfy our legal and accounting obligations.

We provide further control over your personal information with the following options:

  • CLI Analytics Retention. We retain individual CLI analytics events for 13 months. Rebuildable aggregate usage totals may be retained longer without being connected to an account.

  • Account Deletion Request. If you choose to terminate your account with us, you can request the deletion of your user account by contacting us. We will process such requests in accordance with applicable law. Some information may remain in our archives or backups for a period necessary for our legitimate business purposes or as required by law (such as records of completed billing transactions), and may be isolated from further processing rather than fully deleted.

  • Sandbox and Credential Deletion. You may delete compute sandboxes and stored credentials through the Service at any time.

6. How Do We Keep Your Information Safe?

In Short: No system is 100% secure.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

7. Do We Collect Information From Minors?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

The Service is not intended for, and we do not knowingly solicit data from or market to, children under 18 years of age. By using the Service, you represent that you are at least 18. If we learn that personal information from users under 13 years of age has been collected, we will deactivate the account and delete such data in accordance with the Children's Online Privacy Protection Act ("COPPA"). For users we learn to be between 13 and 17 years of age, we may deactivate the account at our discretion. 8. What Are Your Privacy Rights?

In Short: In some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us using the contact details provided in the section "How Can You Contact Us About This Notice?" below. We will consider and act upon any request in accordance with applicable data protection laws.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us using the contact details provided in the section "How Can You Contact Us About This Notice?" below. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can do so through the Service's account settings or by contacting us using the contact information provided. We will process such requests in accordance with applicable law. We may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms, comply with applicable legal and accounting requirements, or maintain backups.

9. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

10. Do United States Residents Have Specific Privacy Rights?

In Short: If you are a resident of California, you are granted specific rights regarding access to your personal information.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months.

California Residents

California Civil Code Section 1798.83, also known as the "Shine The Light" law permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

CCPA Privacy Notice

This section applies only to California residents. Under the California Consumer Privacy Act (CCPA), you have the rights listed below.

The California Code of Regulations defines a "resident" as: (1) every individual who is in the State of California for other than a temporary or transitory purpose and (2) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose. All other individuals are defined as "non-residents."

If this definition of "resident" applies to you, we must adhere to certain rights and obligations regarding your personal information.

Your rights with respect to your personal data

  • Right to request deletion of the data — Request to delete. You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.
  • Right to be informed — Request to know. Depending on the circumstances, you have a right to know: whether we collect and use your personal information; the categories of personal information that we collect; the purposes for which the collected personal information is used; whether we sell or share personal information to third parties; the categories of personal information that we sold, shared, or disclosed for a business purpose; the categories of third parties to whom the personal information was sold, shared, or disclosed for a business purpose; the business or commercial purpose for collecting, selling, or sharing personal information; and the specific pieces of personal information we collected about you.
  • Right to Non-Discrimination for the Exercise of a Consumer's Privacy Rights. We will not discriminate against you if you exercise your privacy rights.
  • Right to Limit Use and Disclosure of Sensitive Personal Information. We do not process consumer's sensitive personal information.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Other privacy rights

  • You may object to the processing of your personal information.
  • You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.
  • You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
  • You may request to opt out from future selling or sharing of your personal information to third parties. Upon receiving an opt-out request, we will act upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.
